These terms apply to every AsOf Report, Preserve engagement, and records-certification affidavit ordered from substradium.com. The engagement letter for quoted work (Coverage History, Successor, audits, testimony days) supersedes them where the two differ.
What you are buying
- A records product. A Substradium report states what the public federal carrier record showed on a date, reconstructed from Substradium's dated captures and from federal history files, with the source, capture date, and archive fingerprint of every fact.
- Not legal advice, not an opinion, not a prediction. Substradium is not a law firm, not an expert witness, and not a consumer reporting agency. Your retained expert interprets the record; we certify what it showed.
- Stated coverage. Every lane of the record has a capture boundary, printed in the report. Before the boundary, facts are event-dated reconstructions and are labeled as such. A fact that is not in the record is reported as not captured, never inferred.
Ordering, payment, delivery
- Posted prices are per carrier and per date. Complex scope (multiple dates or carriers) is quoted before work starts.
- Checkout orders start the 48-hour delivery clock at payment. Invoiced orders start it when the invoice is paid; invoices are net 30 and nothing is produced or charged before payment.
- Delivery is a PDF with an HTML and JSON copy and a SHA-256 hash of the JSON, sent to the ordering address. A report is retrievable by its hash for as long as Substradium operates the archive.
- If the record cannot support a report for your carrier and date, you are told before any work is billed and any payment is refunded in full.
Use
- You may use a report in the matter it was ordered for, including filing it, producing it in discovery, and attaching it to expert work. Certification and custodian testimony are separate, priced rungs.
- You may not resell a report, strip its provenance appendix, or present an excerpt as the whole. Aggregate and anonymized use of order data by Substradium is permitted; your identity and matter are never disclosed.
Limits
- Substradium's liability on any order is limited to the amount paid for it. The federal record is the government's; Substradium certifies its captures of that record, not the record's truth.
- Texas law governs; venue is Texas.
